Please read these terms and conditions carefully before using our website and services.
1. About UsTerms of Sale
These terms apply to every reservation and purchase of the EW01 from EMPIRICAL Labs.
1. Eligibility
You must be 18 or over to place an order. Each person may reserve a maximum of two watches.
2. Price
The EW01 is priced at USD 600, excluding shipping. Prices are shown in US dollars.
3. Payment
3.1 You may reserve your watch with a deposit of USD 280.
3.2 The remaining USD 320, plus shipping, is payable when we invoice you, approximately one month before delivery.
3.3 All payments are processed securely by Stripe. We do not see or store your card details.
4. Deposits
4.1 Your deposit secures your watch within the limited edition and allows us to begin production. Deposits are non-refundable, except as set out below.
4.2 If we do not proceed with production, your deposit will be refunded in full.
4.3 If delivery is delayed by more than 8 months from your deposit payment, you may request a full refund of your deposit.
4.4 You may request to cancel your reservation before we confirm production. Any such request is subject to our approval, at our discretion, with a deduction of processing fee from our payment provider. Once production is confirmed, reservations cannot be cancelled.
5. Balance Payment
5.1 The balance must be paid within 14 calendar days of the date of our invoice.
5.2 If the balance is not paid within this period, we may cancel your order. In that case, your deposit will be retained.
6. Production and Delivery
6.1 Each EW01 is made to order in a single limited production run. Delivery dates are estimates only and are not guaranteed.
6.2 We will keep you informed of progress and of any change to the estimated delivery date.
6.3 We are not responsible for delays caused by events outside our reasonable control, including supplier, manufacturing, customs or courier delays.
7. Product Specifications and Variations
7.1 The EW01 is made using natural materials, including a natural aventurine dial. Each watch is unique, and colour, pattern and finish may vary.
7.2 We may make minor changes to the design, materials, components or specifications before delivery, provided these do not materially affect the function or overall appearance of the watch.
8. Shipping, Duties and Taxes
8.1 We ship worldwide. Shipping costs are calculated and payable with the balance.
8.2 Import duties, taxes and customs charges in your country are your responsibility and are not included in the price.
8.3 Risk in the watch passes to you on delivery.
9. Damaged or Faulty on Arrival
If your watch arrives damaged or faulty, you must notify us at contact@empirical.institute within 7 calendar days of delivery, with photos or video. Once we have verified the issue, we will replace the watch.
10. Returns and Refunds
Because each EW01 is made to order, we do not accept returns or offer refunds after delivery, except as set out in clause 9 and in our Warranty Conditions.
11. Limitation of Liability
To the extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order.
12. Your Statutory Rights
Nothing in these terms affects any rights you have that cannot be excluded or limited by law.
13. Governing Law
These terms are governed by the laws of Malaysia, and any dispute is subject to the jurisdiction of the Malaysian courts.
